Smith v. Williams United States Court Of Appeals Fifth Circuit. read online review & book description:
This action involves Section 2283 of the Judicial Code, 28 U.S.C.A. ? 2283 restricting the power of federal courts to enjoin state court proceedings. The subject matter of the action, compensation to a waterfront worker, is a sore spot in federal-state relations. The question for decision is whether a federal court may enjoin compensation proceedings brought by a longshoreman against his employer in a state court under a state act when, as federal courts see it, the longshoremans remedy is exclusively under the federal Longshoremens and Harbor Workers Compensation Act, 33 U.S.C.A. ? 901 et seq. We hold that no injunction may issue.
